Former Gucci manager claims overtime payment

A former operation manager of Gucci (China) Trading Ltd has filed for overtime payment worth hundreds of thousands of yuan. The manager submitted the labor arbitration application on Aug 19 in Beijing, National Business Daily reported Wednesday.

Chaoyang Arbitration Committee for Labor Disputes has accepted the labor arbitration application.

The former employee's lawyer He Li said that an attendance sheet approved by the company showed the former employee frequently worked overtime without payment in the past two years, the paper reported.

"Overtime work of more than three hours a day or more than 36 hours a month is illegal, regardless of whether it is paid or not paid, and regardless of existing agreement from employees," Li was quoted as saying.

The legal department of Gucci (China) told the paper "the company has clear rules that any overtime payment specified in the national law will be paid to employees, and the company abides by this."

The former operation manager filed the complaint after Gucci (China) did not renew their contract of a 18,000 yuan ($2,813) monthly payment, which ended on May 31. The former employee served the company for five years after starting as a store manager with a 7,500 yuan monthly payment, the paper said.
